No Refund Policy

Due to the digital nature of our Products, ALL SALES ARE FINAL. We do not offer refunds, exchanges, or credits once a Product has been purchased and access has been granted, except where required by applicable law.

By completing a purchase, you expressly acknowledge that: (i) you are purchasing a digital product; (ii) delivery of the digital content begins immediately upon purchase; and (iii) you waive any applicable statutory cancellation or withdrawal rights to the extent permitted by law.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO DIPLOMAT ACADEMY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.

TO THE FULLEST EXTENT PERMITTED BY LAW, DIPLOMAT ACADEMY EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless VALUEMINT LLC, its members, managers, officers, employees, contractors, agents, licensors, and successors (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

This indemnification obligation survives the termination of these Terms and your use of the Site.

Mandatory Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or our Products ("Dispute") shall be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court.

Class Action Waiver

YOU AND DIPLOMAT ACADEMY EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, REPRESENTATIVE ACTION, OR CONSOLIDATED ARBITRATION. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY.

Exceptions

Either party may bring an individual action in small claims court. Either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

Opt-Out

You may opt out of mandatory arbitration within 30 days of first accepting these Terms by sending written notice to legal@diplomat.academy. Opting out does not affect any other provision of these Terms.

These Terms and any Dispute shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law principles.

To the extent that any matter is not subject to arbitration under Section 12, the parties consent to the exclusive jurisdiction of the state and federal courts located in Laramie County, Wyoming.

By using our Site, you consent to the collection and use of your information as described in our Privacy Policy, including compliance with the California Consumer Privacy Act (CCPA) where applicable.

We may use cookies and similar tracking technologies. By continuing to use our Site, you consent to such use in accordance with our Cookie Policy.

Our Products are offered in English only. Diplomat Academy operates from Wyoming, USA, and products are available globally. By accessing our Products from outside the United States, you do so at your own initiative and are responsible for compliance with local laws.

You represent that you are not located in a country subject to a U.S. Government embargo or on any U.S. Government restricted-party list. You agree not to export or re-export our Products in violation of U.S. export control laws and regulations.

Upon termination, your license to use any Content is immediately revoked. No refunds will be issued for terminations resulting from violations of these Terms.

Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Diplomat Academy with respect to the subject matter hereof and supersede all prior agreements.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

No Waiver

Failure by Diplomat Academy to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. Diplomat Academy may freely assign these Terms in connection with a merger, acquisition, or sale of assets.

Force Majeure

Diplomat Academy shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, war, governmental action, natural disasters, or internet outages.
